Deposition regarding library records prior to 1995
  
   The following is deposition provided by former library trustee Hazel Taber during litigation between the town and the former board of library trustees:

   Attorney: Can you tell me, please, based on your recollection all the reasons that were put fourth in support of the idea of establishing a foundation and then transferring most of the assets from the Inc. into the foundation?

   Taber: Well, to me, it goes back to when I first became a trustee. The finances of the library were zilch and the records, the financial records, were in very, very poor form.

   Attorney: Are you talking about the public library's records?

   Taber: No, no. The trustee's funds were in sad affairs.

   Attorney: Were in what, sad affairs?

   Taber: Said affairs, yes. Over the years, they - we became - we invested - got it straightened out, invested it and then received a huge endowment.

   Attorney: From Mr. Silva?

   Taber: Exactly. So with that we decided to protect the funds we had, not just let them sit because I recall, from my appointment, my memory, the records were so misconstrued in the early 1990s that I saw it as a way to protect the funds.

    Attorney: What do you mean by "the records were" - they were in disarray? I'm sorry. I don't want to put words in your mouth.

   Taber: I remember when I first became a trustee, this one man had resigned. This man took over and he had a horrible time just finding receipts, finding deposits. The bookkeeping was just horrible. So then this girl, this friends of mine, Barbara, took over as treasurer and she and this group worked diligently to get the finances straightened out, and they concentrated a lot on keeping them.

   Attorney: How long did that take to get the records straightened out?

   Taber: Over a year.

   Attorney: That was in the mid 1990s, you think?

   Taber: I'm saying around 1994.
